THESE TERMS OF SERVICE ("TERMS") GOVERN YOUR ACCESS TO AND USE OF WEBSITES AND ONLINE PAGES OPERATED BY ELIAS WICK AB ("ELIAS WICK", "WE", "US", OR "OUR") THAT LINK TO THESE TERMS (TOGETHER, THE "SITE"), INCLUDING ANY CONTENT, FUNCTIONALITY, PRODUCTS, AND SERVICES WE MAKE AVAILABLE THROUGH THE SITE (TOGETHER, THE "SERVICES").

PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCESSING OR USING THE SERVICES, YOU CONFIRM THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

2. Eligibility & key rules

You must be at least 18 years old (or the age of majority where you reside) to use the Services. If you are under the age of majority, a parent or legal guardian must review and accept these Terms on your behalf and will be considered the contracting party responsible for your use of the Services, to the extent permitted by applicable law.
You are responsible for your activity and for the accuracy of information you provide to us.

3. Changes to the Services or these Terms

We may update the Services and these Terms from time to time. When we make material changes, we'll change the "Last updated" date above and, where appropriate, provide additional notice. Your continued use after changes means you accept the updated Terms.

4. Our Services & third-party platforms

The Site provides content, functionality, products, and services, and links to our storefronts on Epic Games Fab and Gumroad where purchases occur.
Purchases, billing, taxes, refunds, delivery, and store accounts are handled by the relevant platform under its policies and terms. Where their terms conflict with this document for a purchase made there, the platform's terms apply to that purchase.
We may add, change, or discontinue features at any time.

5. Accounts & security

The Site does not offer customer accounts at this time. If in the future we add accounts, you must keep your credentials confidential and notify us of any suspected compromise.
Any accounts you create on third-party platforms (for example, Fab, Gumroad) are governed by those platforms' terms.

6. Acceptable use

You agree not to, and not to enable others to:

break the law, infringe IP rights, or violate others' privacy;
upload or send malware, spam, or content that is unlawful, deceptive, defamatory, or abusive;
scrape, copy at scale, or interfere with the operation or security of the Services;
misrepresent your identity or affiliation;
circumvent access controls, rate limits, or technical protections.

We may suspend or restrict access if we reasonably believe a breach has occurred or to protect the Services or other users.

7. Your content & feedback

If you submit, post, or share content with us through the Services or our official channels (for example, comments, emails, form submissions, testimonials, bug reports, feature ideas) ("User Content"):

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and display that User Content for operating, improving, and promoting the Services, subject to our Privacy Policy.
You represent that you have the necessary rights to your User Content and that it does not infringe others' rights or the law.
We may moderate, remove, or decline to display User Content at our discretion.

If you provide feedback or suggestions, you agree that we may use them without restriction or obligation to you. While we may, at our discretion, choose to acknowledge, highlight, or give credit to contributors who provide helpful input or give back to the community, such actions are entirely voluntary and do not create any obligation, entitlement, or expectation.

8. Intellectual property & license to use the Site

The Services and all materials we publish (including text, videos, images, tutorials, designs, branding, and code on the Site) are owned by Elias Wick AB or our licensors and are protected by law.
We grant you a limited, revocable, non-transferable, non-sublicensable license to access and view the Site for personal or internal business use by you.
You may not copy, modify, distribute, host, sell, or exploit Site materials except as allowed by applicable law or by an express license we provide.
All downloads, plugins, tools, and assets are governed by their respective product-specific license or End User License Agreement (EULA) provided at the time of purchase or download.

A. Trademarks and third-party rights

Unreal Engine and the Epic Games logo are trademarks or registered trademarks of Epic Games, Inc. in the United States and elsewhere. This website and its products are not affiliated with, endorsed by, or sponsored by Epic Games, Inc.

All other trademarks, service marks, and company names or logos mentioned on the Site are the property of their respective owners. Their inclusion does not imply any affiliation or endorsement.

9. Pricing, taxes, and refunds

Prices, taxes (including VAT), and payment methods are shown on the relevant third-party platform at checkout.
Refunds are handled per our Refund Policy and the platform's policy for the purchase. Please follow the platform's refund flow first; you can also contact us at contact@eliaswick.com.

10. Third-party links and services

The Services may link to third-party websites, storefronts, APIs, SDKs, videos, social networks, or documentation. We do not control and are not responsible for third-party services, their content, security, or policies. Your use of them is at your own risk and subject to their terms.

11. Health & safety (visual content)

Some demonstrations, shaders, or visual effects may include flashing or high-contrast imagery. If you are sensitive to such content, consider limiting exposure, using a well-lit environment, and taking breaks.

12. Disclaimers

We provide the Services "as is" and "as available." To the maximum extent permitted by law, we make no warranties (express, implied, or statutory) about the Services, including non-infringement, merchantability, fitness for a particular purpose, availability, accuracy, or error-free operation. These Terms do not limit any non-waivable statutory rights you may have as a consumer under applicable law.

13. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or business interruption arising from or related to the Services or these Terms. To the extent permitted by law, our aggregate liability for all claims relating to the Services will not exceed the greater of (a) USD $100 or (b) the amounts you paid us directly for the relevant item or feature in the twelve (12) months before the claim (excluding amounts paid to third-party platforms). Nothing in these Terms excludes or limits liability where such exclusion or limitation is unlawful.

14. Indemnity (for business users)

If you use the Services on behalf of a business, to the extent permitted by law you agree to defend, indemnify, and hold harmless Elias Wick AB and our personnel from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your or your users' misuse of the Services; (b) your breach of these Terms; or (c) your infringement or misappropriation of third-party rights.

15. Termination

You may stop using the Services at any time. We may suspend or terminate access to some or all of the Services at any time with or without notice; for example, to protect the Services or where we reasonably believe a breach has occurred. Sections that by their nature should survive (for example, IP, disclaimers, liability limits, governing law) survive termination.

16. Governing law; disputes; consumer options

Governing law. These Terms and any non-contractual obligations arise under the laws of Sweden, without regard to conflict-of-laws rules.
Courts. Unless mandatory consumer law gives you a right to bring proceedings elsewhere, disputes may be brought in the courts of Stockholm, Sweden.
EU consumers. If you reside in the EU, you may have the right to bring claims in your local courts and to use the EU Online Dispute Resolution (ODR) platform.
Informal resolution. Before filing, please consider contacting us so we can try to resolve the issue informally.

We do not require binding arbitration or a class-action waiver as a condition of using our Services. Nothing in these Terms limits your right to bring claims before the courts where permitted by applicable law.

17. IP complaints (notice and takedown)

If you believe our Services infringe your intellectual property rights, please follow the Copyright Policy for more information.

18. Privacy

Please see our Privacy Policy for how we collect and process personal data on the Site. The Site does not collect payment details; checkout data is collected by the relevant platform under its own policy.

19. Miscellaneous

No waiver. A failure to enforce a provision is not a waiver.
Severability. If a provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain in effect.
Assignment. You may not assign these Terms without our prior written consent; we may assign to an affiliate or in connection with a merger, sale, or reorganization.
Entire agreement. These Terms (plus any applicable product license and the documents referenced above) are the entire agreement between you and us regarding the Services.
Language. The controlling language of these Terms is English. Translations (if provided) are for convenience only.
